Terms and Conditions

1.GENERAL TERMS 

These terms apply to sales and deliveries between business customers (hereinafter referred to as the “Customer”) and NeoHair Oy (hereinafter referred to as the “Supplier”) made through the Supplier’s B2B online store. These terms apply to all agreements unless otherwise agreed in writing. These terms do not apply to consumer sales.

Formation of Agreement
An agreement is formed when the Customer places an order in the online store and the Supplier sends an order confirmation. The Supplier reserves the right to accept or reject an order for justified reasons (e.g., credit risks or product availability).


2. CUSTOMER AND DATA PROTECTION

The supplier processes the personal data of the customer’s contact persons in accordance with its privacy policy and the EU General Data Protection Regulation (GDPR). The customer is responsible for ensuring that the personal data it provides is accurate and up to date.


3. PRICE

All prices are quoted in euros excluding value added tax (VAT). The applicable VAT rate at the time of invoicing, as well as any delivery and handling charges, will be added to the invoice. The supplier reserves the right to change prices without prior notice.

4. DELIVERY

The delivery time and method are specified in the order confirmation. The supplier is not responsible for delays caused by force majeure or other reasons beyond the supplier’s control.

5. PAYMENT TERMS

The payment term is 14 days net from the date of invoice, unless otherwise agreed. The interest on late payments shall be determined in accordance with the commercial interest rate specified in the Interest Act (633/1982). The supplier may require advance payment from new customers or when deemed necessary based on credit information.


6. RETURN POLICY

These return terms apply to deliveries between NeoHair Oy (hereinafter referred to as the “Supplier”) and business customers (hereinafter referred to as the “Customer”).

In business-to-business (B2B) transactions, there is no statutory right of return. Returns are accepted only if agreed in advance with the Supplier or if there has been an error in the delivery.

Defective or damaged products:
If a delivered product is defective, faulty, or damaged during transport, the Customer must

  • inspect the delivery immediately upon receipt

  • notify the Supplier in writing of the defect within seven (7) days of delivery using the incident report form available in the “Contact Information” section of the ordering channel

The Supplier may, at its discretion

  • deliver a replacement product

  • refund the product price

Defective products must not be returned without written authorization from the Supplier.

Returns based on agreement:
If the Supplier accepts a return for reasons other than a defect (e.g., an extra order), the following conditions apply:

  • The return must be agreed upon in advance with the Supplier.

  • The returned product must be unused, unopened, in its original packaging, and in saleable condition.

  • The Customer is responsible for the shipping costs of the return.

  • The Supplier reserves the right to charge a handling fee (10–20% of the product price) to cover inspection and restocking costs.

Products that cannot be returned:
The following products are non-returnable:

  • Cosmetic or hygiene products whose packaging has been opened

  • Discounted or promotional items

Return process:

  1. The Customer contacts the Supplier by email at apteekit@markbirchhair.com.

  2. The Supplier confirms whether the return can be accepted and, if necessary, provides a return authorization number (RMA).

  3. The product is returned in its original packaging according to the Supplier’s instructions.

  4. The product is inspected, and upon approval, the refund is processed as agreed (e.g., deducted from the next invoice).

Limitation of liability:
The Supplier’s liability is limited to the purchase price of the returned or defective product. The Supplier is not liable for indirect damages, such as loss of sales, logistics costs, or production interruptions.

7. WARRANTY, SUPPORT AND LIABILITY FOR DEFECTS

Warranty
The products are consumable goods and do not include a separate warranty unless otherwise stated in writing by the Supplier or the manufacturer. The warranty does not cover normal wear and tear, improper storage, neglect of usage instructions, mixing of the products with other substances, or defects resulting from improper use.

The product’s shelf life and storage conditions are specified on the packaging or in the product description. The Customer is responsible for ensuring that the products are stored, handled, and sold in accordance with the manufacturer’s instructions.

Support
The Supplier provides product-related support and advice by email or other agreed means. Support covers assistance regarding product information, usage instructions, and technical questions related to resale. The Supplier is not responsible for how the Customer uses the products in its own services or sales channels.

Liability for Defects
The Supplier’s liability is limited solely to products that are demonstrably defective due to a manufacturing or packaging error. The Supplier is not liable for damages resulting from improper use, storage, transport, expiration, or modifications made by the Customer to the product’s composition or labeling.

If a delivered product is found to be defective, the Customer must submit a written complaint to the Supplier within seven (7) days of discovering the defect. The Supplier may, at its discretion:

  • correct the defect

  • deliver a replacement product

  • refund the price of the defective product

Liability for defects does not cover indirect damages such as loss of sales, loss of business relationships, business interruptions, or damage to reputation.

The Supplier’s total liability shall in any case be limited to the invoiced value of the defective product.
